Snow & Ice Injuries

Help for Victims of Snow and Ice Accidents

When you are walking on someone else’s property ― in a supermarket, outside of a business or in an apartment complex ― you probably give little thought to whether or not the conditions are safe. Most of us assume that the owner of the property looks after the maintenance and upkeep of the property. Unfortunately, this doesn’t always happen.

This is especially true in a New England winter. Whether it’s a parking lot, a sidewalk, or even inside a store, property owners are required to keep their property free of snow and ice. When that doesn’t happen, the injuries can be catastrophic.

Who is Responsible for Shoveling?

Every property owner has to keep his/her property free of snow and ice. That means shoveling when it snows and applying some sort of ice melt to prevent ice forming. Depending on the type of property, it might be too much for one person alone. However, that doesn’t mean that the property owner is off the hook.

Instead, whether the property owner is a business or an individual, it must hire some to make sure that the snow is shoveled and the ice melt is put down. This means that in most snow and ice cases, there are usually two entities that are responsible. First, it’s the property owner. But, there is also a property manager, landscaper, or other contractor that is paid to remove snow and ice as it builds.

In these situations, there is usually a contract that explains the responsibilities of both parties. In some of these contracts, the snow plow will only come if there is a certain amount of snow on the ground. Other contracts put 100% of the responsibility on the plow. Still other property owners don’t pay anyone, even though it’s not physically possible for the owner to sufficiently shovel and make the property safe.

Severe Injuries

Snow and Ice cases pit gravity against the human body. Gravity usually wins, and the results can be quite severe. Depending on how a person falls, feet, ankles, and legs can be twisted in an extreme way causing severe fractures that require multiple surgeries. Other times, people land on their back side causing severe spinal injuries. There are also many times where a person’s head slams against the ground, which can cause concussions and traumatic brain injuries.
